Terms of Service

1. Agreement to Terms

By downloading, installing, accessing, or using DiceBuddy ("App," "Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and DiceBuddy regarding your use of the App. Please read them carefully.

2. Eligibility

To use DiceBuddy, you must:

• Be at least 13 years of age (or the minimum age of digital consent in your jurisdiction)
• Have the legal capacity to enter into a binding contract
• Not be prohibited from using the Service under applicable laws
• Use the App only for lawful purposes and in accordance with these Terms

By using the App, you represent and warrant that you meet all of these requirements.

3. License and App Usage

3.1 License Grant

Subject to your compliance with these Terms, DiceBuddy grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial purposes on iOS devices that you own or control.

3.2 License Restrictions

You agree not to:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices from the App
• Transfer, sublicense, lease, lend, sell, rent, or distribute the App
• Use the App for any illegal purpose or in violation of any local, state, national, or international law
• Interfere with or disrupt the App or servers connected to the App
• Attempt to gain unauthorized access to any portion of the App
• Use any automated system to access the App

3.3 App Store Terms

These Terms are between you and DiceBuddy, not with Apple Inc. Apple is not responsible for the App or its content. However, Apple may enforce these Terms as a third-party beneficiary.

4. Accounts and Registration

Certain features of the App may require you to create an account. When you create an account, you must provide accurate, current, and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or outdated.

5. Subscriptions and Payments

5.1 Subscription Plans

DiceBuddy offers both free and paid subscription plans ("Plus" and "Pro"). Features available depend on your subscription tier.

5.2 Billing and Auto-Renewal

• All subscriptions are billed through your Apple ID and charged to your payment method on file with Apple
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions through your Apple ID account settings or App Store

5.3 Cancellation

You may cancel your subscription at any time through your Apple ID settings:

1. Open the Settings app on your iOS device
2. Tap your name at the top
3. Tap "Subscriptions"
4. Select "DiceBuddy"
5. Tap "Cancel Subscription"

Upon cancellation, you will continue to have access to paid features until the end of your current billing period. No refunds will be provided for partial months.

5.4 Free Trials

We may offer free trials for paid subscriptions. At the end of the trial period:

• Your subscription will automatically convert to a paid subscription unless canceled
• You will be charged the applicable subscription fee

5.5 Price Changes

We reserve the right to modify subscription pricing. Any price changes will take effect at the start of the next billing cycle after notice is provided to you.

6. Content and Intellectual Property

6.1 Our Content

The App and its original content, features, and functionality are owned by DiceBuddy and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. This includes:

• Software code and algorithms
• Designs, graphics, and visual elements
• Text, logos, and brand materials
• Game databases and rule information

6.2 Game Rules and Third-Party Content

Game rules, names, and related content displayed in the App are trademarks and copyrights of their respective owners. DiceBuddy does not claim ownership of these materials. The App serves as a reference tool and does not replace official game materials.

6.3 Your Content

You retain ownership of any content you create or upload to the App (such as custom game variants, notes, or profile information). By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content solely for the purpose of operating and improving the App.

You represent that you have the right to share any content you upload and that it does not violate any third-party rights.

7. Prohibited Activities

In addition to other prohibitions, you agree not to:

• Use the App in any way that could disable, overburden, or impair the Service
• Use any robot, spider, or other automatic device to access the App
• Introduce viruses, trojans, or other malicious code
• Attempt to probe, scan, or test the vulnerability of the App
• Harass, abuse, or harm another person through the App
• Impersonate any person or entity
• Share account credentials with others

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of subscription fees
• Extended periods of inactivity

Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. DICEBUDDY MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT
• THAT THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
• THAT THE RESULTS OBTAINED FROM THE USE OF THE APP WILL BE ACCURATE OR RELIABLE
• THAT ANY ERRORS IN THE APP WILL BE CORRECTED

Game rule information is provided for reference only. Always consult official rulebooks for definitive rulings. DiceBuddy is not responsible for disputes arising from rule interpretations.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DICEBUDDY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

• Loss of profits, data, use, or goodwill
• Service interruptions or errors
• Unauthorized access to your data
• Personal injury or property damage

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO DICEBUDDY IN THE 12 MONTHS PRIOR TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to defend, indemnify, and hold harmless DiceBuddy and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your access to or use of the App
• Your violation of these Terms
• Your violation of any third-party right
• Your content posted on the App

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the federal or state courts located in Delaware. You waive any objection to this venue.

13. Dispute Resolution

Before filing any claim against DiceBuddy, you agree to try to resolve the dispute informally by contacting us at support@dicebuddy.app. We'll try to resolve the dispute informally within 30 days.

If we're unable to resolve the dispute, you agree that any dispute will be resolved through binding arbitration in accordance with the American Arbitration Association rules, rather than in court.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our App after any revisions become effective, you agree to be bound by the revised terms.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DiceBuddy regarding the use of the App and supersede any prior agreements.
